Single-Car Accident Lawsuit Dismissed

Christopher E. Wilkins, a partner in the firm, recently received a decision dismissing a negligence action in a single car accident involving the issue of the “Good Samaritan“ doctrine. Monroe County Supreme Court Justice John J. Ark, in a written decision found in favor of Wilkins’ client JC Penney, finding there was no evidence to support plaintiff’s claims the defendant failed to obtain medical assistance or otherwise supervise her in light of an alleged medical emergency. The Judge further stated that if there were negligence, the plaintiff’s subsequent actions were a supervening cause of her injuries.
